As of January 1, 2025, a consent from co-owners in accordance with the provisions of the Official Gazette No. 152/2024 must precede the decision on the categorization of your apartment or holiday home.
In other words, if you wish to rent out your own apartment for short-term stays to third parties/tourists, you must obtain a sufficient number of signatures from your neighbors; otherwise, you will not receive the categorization decision.
By law, the consent is valid for a minimum of 5 years, but it may be revoked before the expiry of this period if house rules and the rights of other co-owners are violated at least 3 or more times per year. Revocation of consent requires the signatures of more than ½ (one-half) of the co-owners.
If you already have a categorization decision and have been renting out your apartment or holiday home to third parties prior to the entry into force of the new law, you are required to obtain the consent of two-thirds of the co-owners by January 1, 2030.
In case of non-compliance with the stated rules, misdemeanor fines range from EUR 1,000 to EUR 5,500 for individuals, and from EUR 2,000 to EUR 10,000 for legal entities.
